Este estudo teve por objetivo conhecer a experiência de mulheres brasileiras e francesasmães de meninas com idade entre três semanas e 11 meses. A perspectiva epistemológica foi aqualitativa e a estratégia metodológica foi a das narrativas psicanalíticas, interpretadas segundo oreferencial winnicottiano. Foi utilizado como mediador da comunicação com as mães o Teste deApercepção Temática Infantil. Os relatos das mulheres brasileiras giraram em torno do processode simbiose e diferenciação entre a díade mãe-bebê, dos recursos empregados para seu manejo eda tarefa da (...) maternidade centralizada na mulher, sendo o pai um colaborador. Os relatos dasfrancesas compartilharam a mesma temática, mas com maior valorização do resgate da própriaautonomia e da do bebê. Além disso, em comparação com as mães brasileiras, a tarefa daeducação da filha foi mais compartilhada por ambos os genitores franceses. (shrink)

O objetivo deste artigo é fazer uma releitura do Projeto para uma psicologia científica de Freud a partir não só do conceito de pulsão de morte, mas principalmente de pulsão de vida. Para tanto, iremos nos ater a uma interpretação do psicanalista Hans Loewald sobre a concepção de pulsão de vida, principalmente no que se refere à relação entre Eros, desenvolvimento cognitivo e ao papel da mãe na inserção do bebê na moralidade e na realidade no período pré-edípico. A pulsão (...) de vida seria concebida ainda como outro princípio do prazer possível, para além do de constância. Em última instância, a possibilidade de leitura que delineia a presença da pulsão de vida no Projeto vinculada à função materna segue em complemento à releitura feminista da psicanálise freudiana empreendida por Joel Whitebook em seus trabalhos mais recentes, também largamente baseados na teoria de Loewald. O tema geral do presente artigo trata da antropologia histórica encontrada em “The Authoritarian Personality” e fundamentada em “Dialética do Esclarecimento”. Especificamente, abordaremos a conceituação que compreende as movimentações pulsionais enquanto natureza interna, fundamento da concepção da antropologia aqui debatida. Com isso, ao falarmos de antropologia e de natureza, não estamos nos referindo a concepções imutáveis e “biologizantes”, mas a noções históricas e contextuais. Para tanto, iremos nos voltar à “Ideia de história natural” adorniana, precisamente à dialética entre história e (...) natureza. No texto, Adorno trata de dois movimentos de tal dialética: uma concepção de Lukács, para quem elementos da história se tornam naturalizados enquanto segundo natureza, o que pode ser exemplificado com o esquematismo hollywoodiano promovido pela indústria cultural; o segundo movimento, sob influência de Walter Benjamin, trata da transitoriedade histórica da natureza, quando resquícios arcaicos reprimidos pelo sentido histórico dominante ressurgem, tornando-se possibilidade de outra orientação histórica. Este debate se mostra importante justamente porque se encontra no cerne da relação entre economia-política/sociologia e psicanálise, os domínios teóricos mais relevantes para a primeira geração da Teoria Crítica. Por mais que pensemos que há uma antropologia implícita para Horkheimer e Adorno – que enxergariam o ser humano enquanto naturalmente agressivo e destruidor –, o nosso intuito é mostrar que, se a antropologia e a natureza são históricas, o ser humano age a partir da pulsão de morte justamente porque o meio social que o forma é ele mesmo dominador, violento, reificado e alienante. ABSTRACT This text intends to rethink the dispute of feminist epistemologies regarding the conception of gender discursive constructions from the background of Freud and Lacan’s thesis. Our basis is Butler’s critique of binary feminist theories regarding the substantialization of the sexual body: if the sexual body is constructed by discourse, it is also a subversive element of discourse, since it cannot be completely determined by cultural gender binarism. We use excerpts from the debate between Butler-Freudian and Lacanian psychoanalysis as a (...) “model case” where such epistemological questions could be analyzed: at first, psychoanalysis is one of the main critical targets of the feminist “second wave”; secondly, psychoanalysis would also have been mobilized in favor of the binary feminist cause; however, for Butler, such feminists would not have sufficiently criticized psychoanalysis, for not attacking the essentialized sexual bodily root that would sustain the binary division between sexes; finally, Butler emphasizes the critical potential that psychoanalysis holds, given the subversive and plastic resistance of the unconscious, drive, desire and body, central notions for non-binary feminist epistemology and remodeling of discursive constructivism. O objetivo do presente texto é repensar a aporia pela qual o livro “Dialética do Esclarecimento” é anunciado, a saber, a autodestruição do esclarecimento ou a procura da liberdade pela racionalidade, mas que culmina em uma regressão. Nossa argumentação perfaz dois caminhos: primeiramente, apresentamos a relação existente na obra entre um tipo de antropologia com bases freudianas e uma leitura da sociologia de Marx. Concebemos a noção de uma estrutura psíquica permeável às condições sócio-históricas do ser humano ocidental. Tal condição (...) é imprescindível para a saída da aporia intimamente relacionada a uma antropologia psíquica ligada a um modo histórico da cultura e sociedade. Na sequência, propomos ainda um paralelo entre a possibilidade de um esclarecimento efetivo por meio do resíduo mítico presente na racionalidade técnica apresentada por Horkheimer e Adorno e a assunção da situação humana de desamparo na visão de mundo religiosa, modo freudiano para se alcançar uma posição mais “científica” em relação à realidade. Nesse contexto, utilizaremos rapidamente parte da teoria de Weber como meio para relacionarmos o esclarecimento à religião no que ambos têm em comum, isto é, a defesa contra o sofrimento, a angústia e o desamparo. Talvez seja por meio da assunção do desamparo na racionalidade situada na visão religiosa de mundo, ou ainda, a assunção do mito na racionalidade técnica do esclarecimento, que permitirá o futuro desenvolvimento de uma “antropologia dialética”, o que resultaria na saída da aporia enquanto condição histórica da racionalidade humana. O artigo relaciona os elementos curriculares propostos por Hobbes no capítulo XXX do Leviatã com as leis naturais descritas nos capítulos XIV e XV. Metodologicamente, o trabalho conduz-se em 4 etapas: 1) listar os conteúdos educacionais explicitados no capítulo XXX; 2) buscar potenciais equivalentes de cada um dos conteúdos listados com aspectos das leis naturais presentes nos capítulos XIV e XV; 3) comparar os argumentos e questões teóricas pertinentes a essas equivalências potenciais; 4) destacar possíveis ampliações interpretativas oriundas da análise (...) comparativa realizada. Dada essa escolha metodológica, justifica-se a ausência de outras referências bibliográficas que não o Leviatã. Dentre os achados, sublinha-se que todos elementos curriculares presentes no capítulo XXX puderam ser articulados com, pelo menos, uma lei natural, merecendo destaque a maior ocorrência de vinculações com a terceira lei de natureza. Procuramos expor o pluralismo de leituras da obra freudiana mediante a exploração da hipótese de historicização da formação psíquica dos sujeitos, especialmente relativa ao complexo de Édipo e Supereu. Partindo da perspectiva de estudos feministas, verificamos no corpus teórico freudiano se há a possibilidade de que o avanço sócio-histórico seja um fator de modificação de concepções que, na leitura freudiana clássica, seriam lidas como imutáveis, fixas e rígidas cultural e historicamente. Madelon Sprengnether, Nancy Chodorow e Judith Butler serão retomadas para (...) criticar a leitura clássica e generalizante do complexo de Édipo enquanto “estrutural”, essencializado e substancializado. Sugerimos que, sendo uma lei hegemônica, a vivência edípica não pode ser completamente ultrapassada, mas pode ser performativamente atuada de formas desviantes de sua estrutura classicamente pensada por Freud. Nesse âmbito, a transmissão geracional é nosso enfoque primordial. Ela é debatida ao menos em três momentos complementares: na análise da filogênese, da herança arcaica e do Édipo social exposta em Totem e tabu, na herança narcísica de expectativas e ideais compreendida em Introdução ao narcisismo e na teoria da perpetuação de valores e tradições morais via identificações geracionais superegoicas que consta nas Novas Conferências sobre Psicanálise. One of the effects of the current COVID-19 pandemic is that low-income countries were pushed further into extreme poverty, exacerbating social inequalities and increasing susceptibility to drug use/abuse in people of all ages. The risks of drug abuse may not be fully understood by all members of society, partly because of the taboo nature of the subject, and partly because of the considerable gap between scientific production/understanding and communication of such knowledge to the public at large. Drug use is a (...) major challenge to social development and a leading cause of school dropout rates worldwide. Some public policies adopted in several countries in recent decades failed to prevent drug use, especially because they focused on imposing combative or coercive measures, investing little or nothing in education and prevention. Here we highlight the role of neuroscience education as a valid approach in drug use education and prevention. We propose building a bridge between schools and scientists by promoting information, student engagement and honest dialogue, and show evidence that public policy regulators should be persuaded to support such science-based education programs in their efforts to effect important positive changes in society. O artigo pretende contribuir com as discussões sobre o ensino de filosofia, partilhando achados de uma pesquisa realizada com duas turmas de estudantes universitários na disciplina de Estética (Curso de Música -Licenciatura). As inovações metodológicas aplicadas nas turmas buscaram valorizar o ensino de filosofia em diálogo permanente com as vivências cotidianas e artísticas dos estudantes através de atividades em sala sistematicamente vinculadas aos temas previstos no programa da disciplina. Os resultados dos dados apontaram que as estratégias metodológicas de ensino utilizadas (...) na disciplina tiveram impacto positivo para o engajamento dos discentes, atuando desenvolvimento de sua criticidade e criatividade. The belief in miracle, as a modality of spiritual/religious coping strategy in the face of stress and psychic suffering, has been discussed in psychological literature with regard to its positive or negative role on the health and well-being of patients and family members. In contemporary times, where pseudo-conflicts between religion and science should have been long overcome, there is still some tendency of interpreting belief in miracle – as the possibility of a cure granted by divine intervention, modifying the normal (...) course of events in a bleak medical diagnosis – as having unhealthy impacts in the care and treatment of health. This position seeks to find a base in the three characteristics of hoping in a miracle, frequently pointed out by psychological literature: it would imply a negation of reality instead of its confrontation; it would be a coping strategy focused on emotion instead of the problem; it would imply seeking to modify the supposed desire of God by extra-natural facts. In this study, we shall critically discuss this position and the dangers of its crystallization by the use of SRC scales in which the act of praying for a miracle is previously classified as a negative strategy. We revisit some tendencies in psychological literature about the subject, taking into consideration the various facets of miracle, sociocultural facts, elements of idiographic nature, and their profound outcomes in the lives of people especially in health contexts. We illustrate the dangers of a hasty generalization of the results of nomothetic studies about the role of belief in miracle with two examples of research in the Brazilian context: one carried out with pregnant women with fetal malformation and the other with family members caring for children and adolescents with cancer under chemotherapeutic treatment. In both studies, the results do not confirm the predominance of the negative aspects associated with the act of praying for a miracle, which we discuss and analyze in light of the phenomenological perspective. In this perspective, “pray for a miracle”, as experienced by patients and caregivers, can be recognized as an act of openness to life, bolstering hope, and the resignification of reality in the psyche. O discurso didático que a escola vem construindo ao longo da história da educação brasileira tem em seu bojo o centralismo epistemológico eurocêntrico institucionalizado. Sendo assim, entendemos ser necessário a constante problematização em torno desses discursos na ação docente. Neste artigo, temos como objetivo analisar a forma como são discursivizadas a História e Cultura Afro-Brasileiras, Africanas, e Indígenas no discurso didático do livro de Física do Ensino Médio Integrado ao Técnico em uso no IFBA, campus Eunápolis. Realizamos uma pesquisa bibliográfica (...) por meio da análise de um corpus constituído de materialidades advindas da coleção, Compreendendo a Física, Alberto Gaspar – 3. ed. – São Paulo: Ática, 2016. Para isso mobilizamos a análise do discurso de linha francesa, as teorias fundantes desta pesquisa de perspectiva multicultural e decolonial, bem como discussões acerca do Livro Didático, esse aparato didático tão presente nas salas de aula e tão pouco consensual. Os resultados apontam que o discurso didático da coleção analisada, não se movimenta para a efetivação de fato da legislação específica do Ensino de História e Cultura Afro-brasileira na rede regular de educação básica. Por isso podemos afirmar que há necessidade de ampliação no plano conceitual e epistemológico do que significa construir uma proposta didática sob a perspectiva racial, que considere para o ensino de Física, as epistemologias africanas e indígenas que potencializam a descolonização deste artefato cultural. El presente artículo analiza la cuestión del materialismo y su relación con el arte en el pensamiento de Walter Benjamin. Es una cuestión harto controvertida en los debates sobre Benjamin, y el artículo estudia minuciosamente sus dos textos fundamentales que abordan la cuestión: El autor como productor y La obra de arte en la era de su reproductibilidad técnica. Antes de ello, se enmarca el problema en el contexto de la época y, en especial, en la relación de Benjamin con (...) Brecht, que fue tomado como uno de los elementos clave para entender el giro materialista del primero. Este hecho perturbó algunos de los colegas como Adorno, Horkheimer y Karplus, que veían a Brecht como un materialista excesivamente ortodoxo. El artículo defiende que si bien Benjamin giró hacia posiciones materialistas a lo largo de la década de los 30, ese materialismo no era como la de la ortodoxia marxista de la época, aunque, efectivamente, fue más allá de los planteamientos modernistas de Adorno. El presente artículo analiza de forma comparativa dos debates estéticos fundamentales del siglo XX, la reproductibilidad técnica y el kitsch. Ambos debates se desarrollaron a lo largo de las décadas 20 y 30, y tuvieron como protagonistas, entro otros, a Adorno y Benjamin. El artículo defiende que existen numerosos elementos comunes en ambos debates, que dan buena cuenta de la controversia filosófica que tuvieron los dos filósofos. Pese a que la discusión entre ellos estalla a partir de la cuestión de (...) la reproductibilidad técnica, en sus textos del kitsch ya se pueden observar muchos elementos que apuntan hacia esa discordancia. The present research examines whether identity essentialism, an important component of psychological essentialism, is a fundamental feature of human cognition. Across three studies (Ntotal = 1723), we report evidence that essentialist intuitions about the identity of kinds are culturally dependent, demographically variable, and easily malleable. The first study considered essentialist intuitions in 10 different countries spread across four continents. Participants were presented with two scenarios meant to elicit essentialist intuitions. Their answers suggest that essentialist intuitions vary dramatically across cultures. Furthermore, (...) these intuitions were found to vary with gender, education, and across eliciting stimuli. The second study further examined whether essentialist intuitions are stable across different kinds of eliciting stimuli. Participants were presented with two different scenarios meant to elicit essentialist intuitions—the “discovery” and “transformation” scenarios. Their answers suggest that the nature of the eliciting stimuli influences whether or not people report essentialist intuitions. Finally, the third study demonstrates that essentialist intuitions are susceptible to framing effects. Keeping the eliciting stimulus (i.e., the scenario) constant, we show that the formulation of the question eliciting a judgment influences whether or not people have essentialist intuitions. Implications of these findings for identity essentialism and psychological essentialism, in general, are discussed. (shrink)

Background: Nurses need moral courage to ensure ethically good care. Moral courage is an individual characteristic and therefore it is relevant to examine its association with nurses’ socio-demographic factors. Objective: To describe nurses’ self-assessed level of moral courage and its association with their socio-demographic factors. Research design: Quantitative descriptive cross-sectional study. The data were collected with Nurses’ Moral Courage Scale and analyzed statistically. Participants and research context: A total of 482 registered nurses from a major university hospital in Southern Finland (...) completed the Finnish language version of Nurses’ Moral Courage Scale in autumn 2017. Ethical considerations: Ethical approval was obtained from the university ethics committee and permission for the data collection from the participating hospital. Ethical principles and scientific guidelines were followed throughout the research process. Findings: Nurses’ self-assessed level of moral courage was rather high. On Visual Analogy Scale (0–10), the mean value was 8.20 and the mean score of the four dimensional, 21-item Nurses’ Moral Courage Scale was 4.09 on a 5-point Likert-type scale. Respondents’ gender, present work role, ethical knowledge base, additional ethics education, self-study as a means to acquire ethical knowledge, and frequency of work situations needing moral courage were statistically significantly associated with nurses’ moral courage. Discussion: Strongest association was found between nurses’ higher moral courage level and formal and informal ethics education. Honesty and patient’s humane and dignified encounter received the highest scores indicating respondents’ internalization of the core values of nursing. Conclusion: Although nurses were fairly morally courageous, moral courage should be a part of nurses’ basic and continuing education thus covering its theoretical and practical learning. Since moral courage is a virtue that can be taught, learnt, and practiced, education is a relevant way to maintain and further strengthen nurses’ moral courage. (shrink)

Many theorists have argued that the meaningfulness of a life is related in some way to the narrative or story that can be told about that life. Relationists claim that a life gains in meaning when a particular set of “narrative relations” obtain between the events that constitute it. Recountists claim that it is the telling of a story about those relations, not the relations themselves, that confers meaning. After identifying problems with existing versions of both of these positions, this (...) paper introduces a new and more satisfying variant of Recountism, centered on the old-fashioned idea that a meaningful life is, in part, an intelligible one. I argue that personal narration does play a role in a meaningful life and that my “Fitting Story” account provides the best explanation of how and why that is so. (shrink)

Background: Nursing practice takes place in a social framework, in which environmental elements and interpersonal relations interact. Ethical climate of the work unit is an important element affecting nurses’ professional and ethical practice. Nevertheless, whatever the environmental circumstances, nurses are expected to be professionally competent providing high-quality care ethically and clinically. Aim: This study examined newly graduated nurses’ perception of the ethical climate of their work environment and its association with their self-assessed professional competence, turnover intentions and job satisfaction. Method: (...) Descriptive, cross-sectional, correlational research design was applied. Participants consisted of 318 newly graduated nurses. Data were collected electronically and analysed statistically. Ethical considerations: Ethical approval and permissions to use instruments and conduct the study were obtained according to required procedures. Data were rendered anonymous to protect participant confidentiality. Completing the questionnaire was interpreted as consent to participate. Findings: Nurses’ overall perception of the ethical climate was positive. More positive perceptions related to peers, patients and physicians, and less positive to hospitals and managers. Strong associations were found between perceived ethical climate and self-assessed competence, turnover intentions in terms of changing job, and job satisfaction in terms of quality of care. Nurses at a higher competence level with positive views of job satisfaction and low turnover intentions perceived the climate significantly more positively. Conclusion: Nursing management responsible for and having the power to implement changes should understand their contribution in ethical leadership, as well as the multidimensional nature of nurses’ work environment and the interaction between work-related factors in planning developmental measures. Future research should focus on issues in nurse managers’ ethical leadership in creating ethical work environments. There is also a need for knowledge of newly graduated nurses’ views of factors which act as enhancers or barriers to positive ethical climates to develop. BackgroundFor many decades, the debate on children’s competence to give informed consent in medical settings concentrated on ethical and legal aspects, with little empirical underpinnings. Recently, data from empirical research became available to advance the discussion. It was shown that children’s competence to consent to clinical research could be accurately assessed by the modified MacArthur Competence Assessment Tool for Clinical Research. Age limits for children to be deemed competent to decide on research participation have been studied: generally children of 11.2 (...) years and above were decision-making competent, while children of 9.6 years and younger were not. Age was pointed out to be the key determining factor in children’s competence. In this article we reflect on policy implications of these findings, considering legal, ethical, developmental and clinical perspectives.DiscussionAlthough assessment of children’s competence has a normative character, ethics, law and clinical practice can benefit from research data. The findings may help to do justice to the capacities children possess and challenges they may face when deciding about treatment and research options. We discuss advantages and drawbacks of standardized competence assessment in children on a case-by-case basis compared to application of a fixed age limit, and conclude that a selective implementation of case-by-case competence assessment in specific populations is preferable. We recommend the implementation of age limits based on empirical evidence. Furthermore, we elaborate on a suitable model for informed consent involving children and parents that would do justice to developmental aspects of children and the specific characteristics of the parent-child dyad.SummaryPrevious research outcomes showed that children’s medical decision-making capacities could be operationalized into a standardized assessment instrument. Recommendations for policies include a dual consent procedure, including both child as well as parents, for children from the age of 12 until they reach majority. For children between 10 and 12 years of age, and in case of children older than 12 years in special research populations of mentally compromised patients, we suggest a case-by-case assessment of children’s competence to consent. Since such a dual consent procedure is fundamentally different from a procedure of parental permission and child assent, and would imply a considerable shift regarding some current legislations, practical implications are elaborated. Soren Kierkegaard's Works of Love, a series of deliberations on the commandment to love one's neighbor, has often been condemned by critics. Here, Ferreira seeks to rehabilitate Works of Love as one of Kierkegaard's most important works. He shows that Kierkegaard's deliberations on love are highly relevant to some important themes in contemporary ethics, including impartiality, duty, equality, mutuality, reciprocity, self-love, sympathy, and sacrifice. Ferreira also argues that Works of Love bears on issues peculiar to a religious ethic, (...) such as the role of God as "middle term," and the possibility of preserving the aesthetic dimensions of love in a religious ethic of relation. For decades, the discussion on children’s competence to consent to medical issues has concentrated around normative concerns, with little progress in clinical practices. Decision-making competence is an important condition in the informed consent model. In pediatrics, clinicians need to strike a proper balance in order to both protect children’s interests when they are not fully able to do so themselves and to respect their autonomy when they are. Children’s competence to consent, however, is currently not assessed in a standardized way. (...) Moreover, the correlation between competence to give informed consent and age in children has never been systematically investigated, nor do we know which factors exactly contribute to children’s competence. Husserl’s notion of definiteness, i.e., completeness is crucial to understanding Husserl’s view of logic, and consequently several related philosophical views, such as his argument against psychologism, his notion of ideality, and his view of formal ontology. Initially Husserl developed the notion of definiteness to clarify Hermann Hankel’s ‘principle of permanence’. One of the first attempts at formulating definiteness can be found in the Philosophy of Arithmetic, where definiteness serves the purpose of the modern notion of ‘soundness’ and leads Husserl to (...) a ‘computational’ view of logic. Inspired by Gauss and Grassmann Husserl then undertakes a further investigation of theories of manifolds. When Husserl subsequently renounces psychologism and changes his view of logic, his idea of definiteness also develops. The notion of definiteness is discussed most extensively in the pair of lectures Husserl gave in front of the mathematical society in Göttingen (1901). A detailed analysis of the lectures, together with an elaboration of Husserl’s lectures on logic beginning in 1895, shows that Husserl meant by definiteness what is today called ‘categoricity’. In so doing Husserl was not doing anything particularly original; since Dedekind’s ‘Was sind und sollen die Zahlen’ (1888) the notion was ‘in the air’. It also characterizes Hilbert’s (1900) notion of completeness. In the end, Husserl’s view of definiteness is discussed in light of Gödel’s (1931) incompleteness results. (shrink)

One of the most basic functions of human language is to convey who did what to whom. In the world's languages, the order of these three constituents (subject [S], verb [V], and object [O]) is uneven, with SOV and SVO being most common. Recent experiments using experimentally elicited pantomime provide a possible explanation of the prevalence of SOV, but extant explanations for the prevalence of SVO could benefit from further empirical support. Here, we test whether SVO might emerge because (a) (...) SOV is not well suited for describing reversible events (a woman pushing a boy) and (b) pressures to be efficient and mention subjects before objects conspire to rule out many other alternatives. We tested this by asking participants to describe reversible and non‐reversible events in pantomime, and we instructed some participants to be consistent in the form of their gestures and to teach them to the experimenter. These manipulations led to the emergence of SVO in speakers of both English (SVO) and Turkish (SOV). (shrink)

We show how to interpret intuitionistic propositional logic into a predicative second-order intuitionistic propositional system having only the conditional and the universal second-order quantifier. We comment on this fact. We argue that it supports the legitimacy of using classical logic in a predicative setting, even though the philosophical cast of predicativism is nonrealistic. We also note that the absence of disjunction and existential quantifications allows one to have a process of normalization of proofs that avoids the use of "commuting conversions.".

As the use of algorithmic decision‐making becomes more commonplace, so too does the worry that these algorithms are often inscrutable and our use of them is a threat to our agency. Since we do not understand why an inscrutable process recommends one option over another, we lose our ability to judge whether the guidance is appropriate and are vulnerable to being led astray. In response, I claim that a process being inscrutable does not automatically make its guidance inappropriate. This phenomenon (...) is not restricted to algorithms, and there are many social processes which we should conform to but are similarly unable to judge for ourselves. I provide a framework for how we can depend on inscrutable processes by introducing a distinction between knowing conformity (where I understand what justifies the guidance) from mere conformity (where I merely do what I am told) and showing how mere conformity is often positively valuable because it allows for extended processes that in turn allow us to accomplish more than we could on our own. This is in effect a division of deliberative labour, which I argue is something commonplace but not often recognised, of which algorithmic guidance can be an example. (shrink)

In this paper, we intend to offer an interpretation about the explanation of the (relative) idea of pure substance in general on John Locke’s philosophy, from Thomas Reid’s notion of ‘natural suggestion’. To achieve this aim, after contextualizing Locke’s notion of pure substance in general and distinguishing it from the idea of particular substance (section 1), we explicit that Locke’s words about the source of the idea of the former in the mind (either empirical or rational) are ambiguous and inconclusive (...) (section 2). Then, we argue that the parallels between this idea and that of ‘relation’, as well as of ‘power’ do not assist in that answer, due to some problems we identify on them (section 3). Finally, we argue that the Reidian explanation for the source of the idea of ‘mind’, from the notion of ‘natural suggestion’ allows us to i) avoid those problems and ii) inasmuch as, according to this interpretation, the idea of pure substance in general would have an empirical source, Lockian empiricism would remain intact (section 4). In “Judy Benjamin is a Sleeping Beauty” (2010) Bovens recognises a certain similarity between the Sleeping Beauty (SB) and the Judy Benjamin (JB). But he does not recognise the dissimilarity between underlying protocols (as spelled out in Shafer (1985). Protocols are expressed in conditional probability tables that spell out the probability of coming to learn various propositions conditional on the actual state of the world. The principle of total evidence requires that we not update on the content of the proposition (...) learned but rather on the fact that we learn the proposition in question. Now attention to protocols drives a wedge between the SB and the JB. We have shown that the solution to a close variant of the SB which involves a clear protocol is P*(Heads) = 1/3 and since Beauty’s has precisely the same information at her disposal in the original SB at the time that she is asked to state her credence for Heads, the same solution should hold. The solution to the JB, on the other hand, is dependent on Judy’s probability distribution over protocols. One reasonable protocol yields P(Red) = 1/2, but Judy could also defend alternative values or a range of values in the interval [1/3, 1/2] depending on her probability distribution over protocols. The concept of animal welfare refersto the animal''s quality of life. The choice ofdefinition always reflects some basicvaluation. This makes a particular conceptionof welfare value-dependent. Also, the animalhusbandry system reflects certain values oraims. The values reflected in the chosenconception of animal welfare ought tocorrespond to values aimed for in the husbandrysystem. The IFOAM Basic Standards and otherwritings dealing with organic animal husbandryshould be taken as a departure point for adiscussion of how to interpret the conceptionof welfare in organic farming systems. (...) Theconception of welfare is related to two corevalues in the organic agriculture movement.These core values should be considered in termsof (1) aim for holistic view and (2) aim forsustainability. A third, implicit core value,based on bio- and ecocentric views: (3) respectfor nature is needed as a supplement to thesetwo core values. There are importantimplications of these core values for an``organic'''' conception of animal welfare and forconfronting two dilemmas due to conflictinginterests. Comparisons among the three commonlyused welfare definitions will show thesuperiority of the third approach, which canprovide an outline for a conception of animalwelfare more suitable for organic farmingsystems. This outline combines a holisticecocentric approach with respect for theindividual animal, and it can be used as thebasis for a complex definition with emphasis onnatural behavior. Such a systemic approachconsiders welfare in relation to differentsystemic levels. The systemic view also offerspossibilities for resolving the dilemmas in newways. (shrink)

Although law is established on a strong presumption that persons younger than a certain age are not competent to consent, statutory age limits for asking children’s consent to clinical research differ widely internationally. From a clinical perspective, competence is assumed to involve many factors including the developmental stage, the influence of parents and peers, and life experience. We examined potential determining factors for children’s competence to consent to clinical research and to what extent they explain the variation in competence judgments.

Richard Tieszen [Tieszen, R. (2005). Philosophy and Phenomenological Research, LXX(1), 153–173.] has argued that the group-theoretical approach to modern geometry can be seen as a realization of Edmund Husserl’s view of eidetic intuition. In support of Tieszen’s claim, the present article discusses Husserl’s approach to geometry in 1886–1902. Husserl’s first detailed discussion of the concept of group and invariants under transformations takes place in his notes on Hilbert’s Memoir Ueber die Grundlagen der Geometrie that Hilbert wrote during the winter 1901–1902. (...) Husserl’s interest in the Memoir is a continuation of his long-standing concern about analytic geometry and in particular Riemann and Helmholtz’s approach to geometry. Husserl favored a non-metrical approach to geometry; thus the topological nature of Hilbert’s Memoir must have been intriguing to him. The task of phenomenology is to describe the givenness of this logos, hence Husserl needed to develop the notion of eidetic intuition. (shrink)

The increasing use of digital technologies in judicial and arbitration proceedings increases the usage of digital evidence by the parties, which brings the necessity of creating patterns for adjudicators to admit and assess this new type of evidence. This paper generally addresses digital evidence focusing on the second moment in international arbitration proceedings. It also narrows the topic to hacked and leaked evidence and its admissibility in international arbitration. The literature review showed a significant amount of research devoted to the (...) evidence in arbitration. Some considered electronic evidence within one jurisdiction; others focused on certain forms of digital evidence such as electronic signatures. Papers on digital evidence in international arbitration approach arbitration rules for digital evidence but skip admissibility issues. No systemic and complex works research digital evidence in arbitration, explicitly focusing on the admissibility of hacked and leaked digital evidence from a comparative perspective. Also, no research deals with enforcing international arbitration awards relying on illegally obtained digital evidence. In these cases, there could be a possible violation of domestic public policy under the New York Convention terms (art. V, 2, b). That is why the paper aims to offer the concept of digital evidence in international arbitration, including hacked and leaked evidence, criteria of its admissibility and relevance, and design the arbitration guidelines for assessing hacked and leaked evidence. Comparative legal analysis of the international arbitration rules and national procedure law allowed us to compare the regulatory approaches to the definition of digital evidence and its admissibility worldwide. The method of legal modeling allowed designing model guidelines for arbitral tribunals to evaluate the admissibility and relevance of digital evidence, including hacked and leaked evidence. Moreover, the case study method allowed us to analyze jurisprudence and define criteria for admission of hacked and leaked evidence. We conclude that the admissibility of hacked and leaked evidence depends solely on the arbitrator’s broad discretion to assess the evidence. Nevertheless, thorough evidence analysis and a well-reasoned award are always mandatory. (shrink)
